1. Introduction & Scope
Welcome to Holistic Drip ("Company", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of our website, booking platform, and mobile wellness services. By requesting or receiving services from Holistic Drip, you agree to be bound by these Terms.
2. Medical Disclaimer & Emergency Warning
Not Emergency Care: Holistic Drip is a wellness and elective therapy service. We do not provide emergency medical care. If you are experiencing chest pain, difficulty breathing, severe allergic reaction, or any life-threatening symptoms, call 911 immediately or go to the nearest emergency room.
No Doctor-Patient Relationship via Website: Use of this website or submission of a request form does not create a provider-patient relationship. That relationship is only established once a licensed nurse or provider has reviewed your medical history and consented to treat you.
Scope of Practice: All services are administered by Board-Certified Registered Nurses (RNs) under the supervision of a Medical Director, in accordance with New York State laws.
3. Appointment Requests & Booking Policy
Request Only: The "Request Appointment" feature on our website is an inquiry, not a confirmed booking. No appointment is guaranteed until you receive a formal "Appointment Confirmed" notification from us.
Right to Refuse: We reserve the right to decline service to any client for any reason, including but not limited to: medical contraindications, safety concerns, or lack of availability.
Gate & Security Access: You are responsible for providing clear, safe, and legal access to your location (home, office, or hotel). If our nurse is denied entry by security, doormen, or gate staff due to your failure to authorize access, the appointment will be considered a "Late Cancellation" (see below).
4. Payments & Cancellation Policy
Authorization Holds: A credit card is required to secure a booking request. A hold may be placed on your card, but you will typically not be charged until the service is approved or completed.
Cancellation & Rescheduling
24-Hour Notice: Cancellations made more than 24 hours before the appointment are fully refundable.
Late Cancellation: Cancellations made within 24 hours of the appointment time incur a $100 Cancellation Fee.
No-Show / Lock-Out: If our nurse arrives and cannot access the premises, or you are not present, you will be charged 100% of the service fee.
5. Consent to Treat & Risks
Before receiving treatment, you will be required to sign a specific Medical Consent & Intake Form. You acknowledge that IV therapy involves risks, including but not limited to bruising, infection, vein inflammation, and allergic reactions.
6. Limitation of Liability
To the fullest extent permitted by New York law, Holistic Drip shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. You agree to indemnify and hold harmless Holistic Drip, its officers, medical directors, and employees from any claims resulting from your failure to disclose accurate medical history.
7. Governing Law & Dispute Resolution
Please read this section carefully. It affects your legal rights.
A. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
B. Informal Resolution: In the event of any dispute, claim, or controversy arising out of or relating to these Terms or our services, you agree to first contact us at info@holisticdrip.com and attempt to resolve the matter informally for a period of at least thirty (30) days.
C. Binding Arbitration: If the dispute is not resolved informally, it shall be settled exclusively by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration shall take place in Suffolk County, New York. The arbitrator’s decision shall be final and binding. You waive your right to a trial by jury.
D. Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the full extent permitted by law, (i) no arbitration or proceeding shall be joined with any other; and (ii) there is no right or authority for any dispute to be arbitrated or resolved on a class-action basis.
